Kano Chieftaincy Tussle: Appellant Heads to Supreme Court

Alhaji Aminu Dan Agundi, a prominent kingmaker in the Kano Emirate, has announced plans to appeal the recent Court of Appeal ruling to the Supreme Court, following a decision that vacated a previous High Court order which had nullified the reappointment of Sanusi Lamido Sanusi as the 16th Emir of Kano.

The Court of Appeal, in a ruling delivered on Friday, voided the June 20, 2024, decision by Justice Abubakar Liman of the Federal High Court, which invalidated the Kano State Emirates Council (Repeal) Law of 2024 that facilitated Sanusi’s reappointment.

The appellate court ruled that the Federal High Court did not have jurisdiction to intervene in chieftaincy matters, emphasizing that the case fell outside the scope of fundamental human rights.

It also ordered a fresh hearing of a suit filed by the deposed 15th Emir of Kano, Aminu Ado Bayero, challenging his removal by Governor Abba Yusuf.

Dan Agundi, dissatisfied with the ruling, argued that the court had only transferred the case to the Kano State Chief Judge for reassignment and not a substantive decision on the matter.

He has since instructed his lawyers to file an appeal at the Supreme Court, where he hopes to obtain a final resolution on the chieftaincy dispute.

This ongoing legal battle follows significant political actions by Governor Yusuf, who enacted the Kano State Emirate Council (Repeal) Law in May 2024.

This law resulted in the deposition of Emir Bayero and the reappointment of Sanusi, who had been removed by former Governor Ganduje in 2020.

Dan Agundi, along with other dissatisfied kingmakers, had previously secured a court order to maintain the status quo and allow Bayero to remain in power.
